TERMS AND CONDITIONS

Car Park: 271 Milton Road, Milton

Owner: Dosa Investments Pty Ltd ACN 686 755 742 (and includes any person authorised by the Owner)

By entering the Car Park you accept the following terms and conditions which constitute a legal agreement with the Owner. If you do not agree to accept these terms and conditions, you must leave the Car Park immediately.

  1. You must purchase a valid permit to park in the Car Park. A permit is only valid if it has been obtained via Milton Central Parking and has not expired.
  2. At all times you must:
    1. comply with all signs and notices displayed in the Car Park;
    2. park your vehicle wholly within a designated bay, or as otherwise directed;
    3. be authorised to park in a designated area; and
    4. not park in a disabled or handicapped person’s bay without displaying an authorised current disability permit.
  3. You enter and use the Car Park at your sole risk. You must remove all valuables from your vehicle and secure it when unattended. No warranty is given by the Owner that your vehicle is safe and secure while in the Car Park and the Owner is not liable, and you release the Owner from any liability, for any injury, loss or damage to persons or property, however arising, including due to any negligence by the Owner or persons authorised by the Owner.
  4. You may be requested to leave and/or remove your vehicle from the Car Park if you:
    1. breach any of these terms and conditions; or
    2. disturb, inconvenience or injure (or threaten to do so) any person, or damage any property or vehicle in the Car Park, or cause or permit any of those things to occur,
    and you agree to immediately comply with that request.
  5. A breach of these terms and conditions may result in the Owner removing your vehicle by the use of a towing provider, and you irrevocably consent to the Owner doing so in these circumstances. Following such removal, your vehicle will not be released until you have provided reasonable identification that you are the owner of the vehicle and pay any money relating to the removal and release permitted by law.
  6. You agree to indemnify the Owner against any and all claims, costs, demands, loss, expenses incurred or suffered by the Owner arising out of your breach of these terms and conditions, your negligence, or the use of the Car Park to park your vehicle.
  7. The Car Park is monitored by use of CCTVs.
